Richard De Liberty is a successful litigator specializing in complex business and intellectual property matters. Richard is experienced in trademarks, copyrights, trade secrets, complex contracts and accounting, business torts, free speech, bankruptcy-related litigation, and enforcing writs and judgments. Richard has a winning record as a trial lawyer in state and federal court and in JAMS and AAA arbitrations.

Richard is also an appeals lawyer with an exceptional record of results. Richard won reversal of a district court’s reductions to an attorney fee award and defeated the cross-appeal, establishing that Copyright Act does not preempt private fee-shifting agreements. Ryan v. Editions Limited West, Inc., 786 F.3d 754 (9th Cir. 2015). Richard won reversal of a superior court’s statutory attorney fee award for technical trespass connected to property-line dispute. Belle Terre Ranch, Inc., v. Wilson, 232 Cal. App. 4th 1468 (2015). And Richard won reversal of a bankruptcy court’s refusal to enforce an arbitration agreement, establishing that arbitration agreements are enforceable even in “core” bankruptcy proceedings. In re Wire Comm Wireless, Inc., No. 07-02451 (E.D. Cal. 2008).

Richard graduated from the College and the Law School of the University of Chicago. Richard trained as an associate at Jenner & Block in Chicago and Heller Ehrman LLP in San Francisco. For a dozen years, Richard lived in Sonoma Country, practicing law at a litigation boutique. Richard returned to the Bay Area in 2016, and now resides in Berkeley.
